Supreme Court Rules in Favor of Same-Sex Marriage

In the groundbreaking case of Obergefell v. Hodges, the Supreme Court of the United States (SCOTUS) ruled on June 26th that the right for same-sex couples to marry is Constitutionally-protected by the Due Process Clause and the Equal Protection Clause of the Fourteenth Amendment. Same-sex marriage is now legal in all 50 U.S. states and the District of Columbia, and couples can no longer be discriminated against in the eyes of the law.

LGBT couples across America who were previously not allowed to marry can now enjoy all of the many legal protections and benefits afforded to married couples. These benefits include:

  • The right to file joint tax returns
  • The right to make medical decisions on behalf of a spouse, or to visit them in the hospital during restricted hours
  • Death benefits, including the right to make funeral arrangements or authorize any post-death procedures
  • The ability to inherit a portion of a deceased spouse’s estate
  • The ability to collect government benefits like Social Security, Medicare, disability, and military benefits for spouses
  • The right to jointly adopt children or apply jointly for foster care rights
  • Guaranteed equitable division of property during a divorce
  • Employment benefits like access to a spouse’s employer-provided insurance, family leave and bereavement, and the ability to collect compensation or retirement benefits for a spouse in the event of their death
  • Other consumer incentives aimed towards families and married couples
